These Terms and Conditions ("Terms") apply to your access and use of MedCeps, an Electronic Data Capture (EDC) platform provided by [Your Company Name]. By registering or using the platform, you agree to be bound by these Terms and all applicable Indian laws.
1. Eligibility
Only authorized clinical researchers, study sponsors, and healthcare professionals may access the platform. You are responsible for ensuring compliance with local ethics committees and institutional guidelines.
2. User Responsibilities
You agree to:
- Maintain confidentiality of your login credentials.
- Use the platform only for lawful and ethical research activities.
- Ensure all patient data is entered in a de-identified or properly consented form.
3. Data Entry & Consent
You are responsible for obtaining informed consent from patients/participants before entering any identifiable data.
You agree not to upload sensitive personal data without meeting the requirements under the DPDP Act or relevant clinical trial regulations.
4. Prohibited Activities
You may not:
- Attempt unauthorized access to other users' data.
- Introduce malware or engage in platform misuse.
- Violate any applicable law or clinical trial guideline.
5. Ownership of Data
Clinical data belongs to the sponsor or institution as per your study agreement.
MedCeps acts as a data processor and will never claim ownership of your data.
6. Platform Availability
While we strive for high availability, downtime may occur for:
- Scheduled maintenance
- Emergency patches
- Force majeure events
We are not liable for losses due to such interruptions.
7. Termination of Access
Access may be suspended or terminated if:
- You violate these Terms
- Your institution ends its agreement with MedCeps
- Misuse or security threats are identified
8. Limitation of Liability
MedCeps is provided on an "as-is" basis. We are not liable for:
- Loss of data caused by user actions
- Any indirect or consequential damages
- Compliance failures by the user or their institution
9. Jurisdiction and Governing Law
These Terms are governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts in Gurugram.
